Terms and Conditions Agreement
Dkhoon AlEmiratia is a company specialized in manufacturing and selling perfumes, incense, cosmetics and personal care products. By using the Dkhoon AlEmiratia online store, you agree to this agreement without restrictions or conditions. Dkhoon AlEmiratia has the right at any time to amend this agreement and the amended version will be published on the store. The amended version of the (Terms and Conditions Agreement) will be valid one week after the date of its publication in the store. After publication, your continued use of the store is considered a commitment from you to the terms and conditions contained in the amended version, and your consent with the application of the amendments.
First: The following terms, whenever they appear in this agreement - the Terms and Conditions Agreement - mean the following:
- Customer/Customers: Any individual or entity who enters the store to view, purchase, or benefit from the products or services offered therein.
- The Store or the Dkhoon AlEmiratia Store: Wherever mentioned in this agreement or in the privacy policy, it means the “Dkhoon AlEmiratia Store” on the web side and on the iPhone and Android applications and any other applications or websites owned by “Dkhoon AlEmiratia Company” Commercial Registration No. “1010393042”, unless the context of the text indicates another meaning.
- Account: It is the page/ history of the customer created for the customer to be able to benefit from the store’s services.
- Product/Products: All products available and displayed in the store.
- The Company: Dkhoon AlEmiratia Company with Commercial Registration No. “1010393042” is the owner of the store.
Second: Conditions for customer logging in the store:
- He must have full eligibility and be over 18 years, and the customer acknowledges that he has full eligibility.
- The customer is obligated to provide the store with the correct information and data required to benefit from the services and purchase from the store.
- The customer is prohibited from doing any act that may cause unlikely or inappropriate pressure on the store or its infrastructure.
- The Customer shall not post or upload any defamatory material, offensive, infringing, harmful, threatening, abusive, twisted, racist, morally inappropriate or other illegal content or information.
- The customer is prohibited from entering or attempting to enter the store without authorization, or granting others the authority to use his account, or impersonating any person or misrepresenting the membership with another person, and the customer shall bear the consequences of his violation of the provisions of this paragraph.
- The customer is prohibited from doing anything that may cause harm or conflict with the intellectual property rights of the store or the Dkhoon AlEmiratia Company.
- The customer is prohibited from uploading or attaching any files, programs or any other materials protected by Intellectual Property Rights Laws or any private or public rights that he does not have the rights to use.
- If the company finds, in its personal discretion, that the customer has breached or violated any of these terms, it has the right to delete, shutdown, suspend, his account or limit the customer’s access to the store or prevent him from using the store, and the company has the right to report the customer to Internet service providers or the competent authorities, or take any legal action.
Third: Terms for benefiting from the store:
- The company displays in the store perfumes, incense products and any other products that it manufactures specifically in the company’s name, or products that it imports or purchases and then displays them in the store for sale to customers.
- The products are displayed in the store and their display includes a picture of the product, an approximate deion of it and the financial value. We confirm that we are as accurate as possible in describing the product and the picture displayed, but we do not guarantee that the deions or pictures match the reality of the product. An error or inaccuracy may occur in them. This clarification is to confirm to the customer that the differences that may occur in the deion of the product or its displayed picture do not mean that the company is negligent or has committed any violations, or that it bears any responsibilities towards those differences in the deion of the product and its displayed pictures.
3.The Products are purchased by placing them in the basket inside the store and then paying the price of the products and the delivery fees shown in the purchase completion steps, which will be estimated based on the company or the contracted shipping companies determining the delivery amount according to the delivery location chosen by the customer.
- The customer is committed to ensuring complete accuracy and entering the correct information to contact him and the location to which the products will be delivered. In the event of any error in the information entered by the customer, the store will not bear any responsibilities for the inability to deliver the products or the delay in delivery, or the delivery of the products to a party other than the customer based on the incorrect information entered by the customer. The customer acknowledges that he is entitled to any claims or compensation from the store.
- It will take (between 3 to 15 days) to deliver the products to the customer inside Saudi Arabia, and it will take (between 3 to 30 days) to deliver the products to the customer outside Saudi Arabia. It is possible that the specified delivery times will increase during seasonal times such as (holidays - National and social events - offers and discounts Times - and other seasons in which demand rates increase in a way that affects the delivery date), and the store will not be responsible for any delay in delivery during seasonal times, and the customer will not have the right to cancel the order or refund the payment due to the delay in delivery.
- The process of delivering products is done through independent shipping companies contracted by the store. Accordingly, any problems that may occur with the products, or in delivery, or in anything related to the sale process that made with the customer due to the shipping company will be responsible towards the customer, and the store will not bear any responsibilities towards the customer.
- The customer acknowledges that his receipt of the products by the shipping company and the shipping company or delivery person leaving from the delivery site constitutes his acknowledgment of receipt of all the products that were ordered according to the deion upon which the purchase was made. He also acknowledges the safety of the products, their packaging and anything related to them, and acknowledges the store’s fulfillment of all its obligations and responsibilities that it contracted for.
- If the product is returned by the shipping company due to the customer’s failure to respond to the shipping company or the delivery person in receiving the product, the customer will bear the payment of other delivery fees that may differ from the previous fees for re-delivering the product again.
- The store will not have any responsibilities or obligations towards the customer after receiving the products from the shipping company.
- There may be errors in the prices of the products displayed on the store. If the customer purchases any of the products at an incorrect price, the customer will be notified of the mistake and will have to complete the difference between the amount paid and the amount required for the price of the product to complete the sale and delivery process. He also has the right not to complete the purchase process and request a refund of the amount paid. In any case, the store will not be obligated to complete the sale process and deliver the products if there is an error in the specified price, even if the customer completes the payment of the amount specified Mistakenly in the store.
- The currency used to price products is (Saudi Riyal), therefore the prices that will appear in the store for other currencies are based on the conversion rate for the Saudi Riyal at that moment, and in any case the approved reference for determining the price of products will be the Saudi Riyal and the prices that appear in the store in other currencies will have no effect in the event of errors or differences in conversion, and the store has the right to refuse to deal with any currencies other than the Saudi Riyal in purchase.
- The customer's request for the product and payment of its price does not mean that the purchase process has been concluded from a legal and legitimate perspective. The completion of the sale process and its conclusion shall be by starting the product delivery procedure - after the customer has paid its price - whether by deliver it to the shipping company or to the company's delivery department. This means that the store has the right not to complete the contract by selling to the customer or to amend the sale details, the price of the products, and the delivery value at any time before starting the process of shipping the products and deliver it to the shipping company, even if the customer has paid the price of the product.
- The products displayed in the store are following the terms and specifications approved by the official authorities in Saudi Arabia. The customer alone is responsible for verifying his own validity, medical validity, and the validity of those under him to use the products. The company does not bear any responsibility for any health problems, diseases, allergies, and others caused by the products, or for violating the specifications and standards of any country other than Saudi Arabia, even if the customer is based there.
- The customer acknowledges that when purchasing products, he relies on his desire to purchase and his assessment of the suitability of the products and their prices for him and does not rely on any evaluations appearing in the store or on any other site for the products, nor on any promotional or marketing methods for the products. Accordingly, the customer is not entitled in any way to pay for being exposed to deception or ignorance after completing the purchase of any products from the store.
- The customer shall bear any fees, taxes or expenses that appear or are imposed by any entity before, or during or after the approval of the purchase and payment process.
- The store has the right, for any reason, to suspend, delete or shutdown the customer’s account without the need to provide any justification to the customer.
- Issuing the bill and delivering the products to the customer does not mean that he has fulfilled his obligations to pay the value of the product, delivery fees, and any other fees. To prove payment, he must present bank s proving the deposit or payment of the amounts due to the company in one of its bank accounts. Nothing else will be accepted to prove that the customer has fulfilled his obligations.
- The store shall not bear any responsibilities or costs for any damages or losses of any kind or otherwise which falls on the customer and his property due to the products.
- The customer commit to all the terms and conditions of this agreement, and in the event of his violation of any of what is stated therein, he is obligated to compensate the store and the company with the necessary compensation and reparation for the damage caused to them, including, but not limited to (damage costs - losses - lost profits - and others).
- The store will not have any responsibilities towards its breach of any of its obligations due to force majeure circumstances over which neither party control.
- The store has the right at any time and without the need to provide a justification and for any reason, whether due to the inability to deliver, or running out of the product, or for any other reason, to cancel the customer's order and return the value paid by him
- In the event that the store breaches any of its obligations in the agreement or breaches any of the customer’s rights or any other obligations, conditions or instructions imposed on it, the compensation due to the customer is limited only to (replacing the product for the customer with a new product if available) or (returning the amount of the product and the delivery fees paid by the customer), and the store will not be obligated to any other compensation other than what was mentioned, and the customer acknowledges his approval of this, and that this is considered an acknowledgment, commitment and waiver from any compensation requests he requests from the store that exceed what was mentioned in this clause.
- In the event that the customer breaches his obligations or any of the provisions of this agreement or manipulates or mistreats the store or the company or fails to pay the value of the products or any financial dues owed to the store or the company, and this results in the claim being directed to the competent authorities, the customer will be obligated to compensate the company for the costs, attorneys’ fees and any other costs that the company may incur in order to obtain its claim, and he is also obligated to compensate it for all damages incurred by it due to his action, including lost profits.
- Imposes customs duties if the order is international
- Please note that shipping to Kuwait and Bahrain is subject to customs duties borne by the customer
Fourth: payment services:
- The customer must make payment through the payment methods available in the store before the store begins providing the service.
- The customer is prohibited from fraudulently using an incorrect or invalid payment method, He is also prohibited from using a stolen payment method, and the customer bears responsibility for violating this clause.
- All payments are made in Saudi Riyals. If the customer pays using another currency, he shall bear the expenses and fees resulting from currency conversion or any other taxes or fees.
- If the customer wishes to cancel the purchase and refund the value of the products, he must submit a request expressing his desire to returns to the store, and the request will be studied by the store and a decision will be made to approve his request or complete the delivery process and not accept the cancellation request. In any case, the customer will not have the right to demand cancellation of the purchase and refund of the amount paid after starting the procedures for shipping the products.
- In cases of refunds to the customer, the amount paid by the customer will be returned after deducting the refund fees imposed by the online payment broker, the bank, or any related entity.
Fifth: Warranty and terms of exchange and return:
- In the event of any defect in the product, or its packaging, or anything related to it, the customer must submit an official request to the store management via official communication means within (24 hours) of receiving the product, and explain in the request the details of the defect and attach pictures showing the existing defect. The request will be studied by the store and a report will be made regarding the customer’s request, either by exchanging the defective product with a new product if available, or compensating the customer with an amount similar to the value of the product in his wallet inside the store, or by rejecting the request submitted by the customer for not being entitled to it. If the customer is late in submitting the request after the specified time, he will not have the right to claim anything related to the products that have been delivered.
- The customer must check the product, and anything related to it upon receiving it from the shipping company or the delivery person, otherwise receiving it will be considered an acknowledgment of the safety of the product, its packaging and anything related to it and that it is approved for his order.
- The customer has the right to request a return of the product within (seven days) from the date of receipt, provided that the product, its packaging, and any accessories sent with it (gifts, etc.) are in their original condition, with all their attachments and codes, and have not been opened or exposed to any scratches or damage. The request will be handled after receiving the product and its accessories sent with it from the customer by returning the value of the product to the customer’s bank account after deducting the delivery fees and the return fees of the shipping company, and any other fees imposed on bank transfers.
- The customer has the right to exchange the product within (seven days) from the date of receipt, provided that the product, its packaging, and any accessories sent with it (gifts, etc.) are in their original condition, with all their attachments and codes, and have not been opened or exposed to any scratches or damage. The request will be handled after receiving the replaced product and its accessories sent with it from the customer by sending the new product, provided that the customer bears the fees for returning the replaced product and the fees for delivering the new product.
- The customer does not have the right to exchange or return any product after seven days from the date of receiving the product.
- Any products purchased under coupons, vouchers or purchased with an account balance in the customer's wallet inside the store will not be returned.
- Whenreturningthe packages, all products must be returned, not parts ofthe package.
- It is valid to agree to exempt the seller from the defect warranty or to limit or increase this warranty unless the seller has deliberately concealed it.
Sixth: General terms:
- The platform has the right to provide the competent authorities with the customer's personal information, including name, identity data, address and bank account, if the customer violates the terms and conditions of the store, or when there is a need to submit a report or register a complaint against it.
- The customer agrees to grant the store the right to use and dispose of his information in developing the store's products and services, and in targeting, marketing and promoting the store's products and services or the products and services of any other parties under the company or contracted, allied or cooperated with, all in the manner decided by the company.
- The customer acknowledges that he has granted the store the authority to access his information related to his device, and any information that the store can access or track through the available technical tools and means, and he also acknowledges that he has been granted the authority to access and determine his location while browsing the store.
- The customer is responsible for any comments, reviews and any content posted by him through the store or its pages, and if he offends the store, company or products, he is responsible for compensating them for the defamation that was done through him.
- The store and the company do not bear any responsibility for what the customer's comments or review for any offensive, ethical or systemic abuses or others.
- The store has the right to delete or hide the customer's reviews and comments from the store without the need to notify him of that.
- The intellectual and commercial property rights of the store and any of its interfaces, contents, symbols, designs, images, products, etc. are owned by the company, and no customer has the right to benefit from or use them without an official written permission from the company.
- The store will not be bound by any promises or statements not indicated in this agreement, even if they are from advertisers or persons under the company.
- The customer acknowledges that the purchase he makes is for personal use, and that he is not entitled to use the products he has purchased in commercial activities or resell them by any means.
Seventh: Notifications:
The store’s correspondence on the official addresses listed on the customer’s registration page or notifications made through the store are legal notifications producing the effects of notification.
Eighth: Litigation and Conflict Resolution:
The laws and regulations of the Kingdom of Saudi Arabia apply to the terms of this agreement, and the competent authority in the city of Riyadh is competent to consider any dispute arising from applying this agreement, and the platform has the right to sue its opponents at their residence before the competent authorities.
